The complaint asserts that Netflix not only failed to secure the material properly but also attempted to downplay the incident following the breach.
The film in question, titled “Fortitude,” is inspired by the historical Operation Fortitude—an elaborate Allied strategy devised during World War II aimed at misleading Nazi Germany regarding the D-Day invasion. This deception relied on a host of tactics, including a fabricated army and double agents, to create an illusion of an impending attack in a different location.
According to the lawsuit, the alleged security breach has inflicted significant financial damage, undermining the film’s marketability and exclusive distribution rights. The plaintiffs claim that they were compelled to suspend marketing and release plans at a critical time ahead of the awards season. Initial test screenings have reportedly indicated a favorable audience response, with an estimated audience score of 82%, forecasting revenue potential upwards of 2.5 million—significantly exceeding its production budget.
Netflix has refuted the claims of negligence, asserting that the film was delivered without appropriate industry safeguards, such as encryption and password protection. The company has countered that the plaintiffs, not Netflix, were responsible for providing an unencrypted version of the film.
