Minnesota woman files lawsuit against Chipotle after hospitalization from sepsis linked to salmonella outbreak in jalapeño peppers
A Minnesota woman is taking legal action against the popular fast-casual restaurant, Chipotle, after falling seriously ill from a reported salmonella outbreak linked to contaminated jalapeño peppers. Kristen Behne has filed a lawsuit in U.S. District Court, seeking damages exceeding ,000, following her hospitalization due to sepsis after consuming a chicken burrito bowl from a Chipotle location in Roseville on June 24. Within days of the meal, she experienced severe symptoms including fainting, fever, and prolonged hospitalization.
According to the lawsuit, genetic testing has confirmed that Behne’s bacterial infection is related to a wider outbreak that has thus far affected over 200 individuals across multiple states. The Minnesota Department of Health has classified her illness as associated with this specific outbreak as of July 1. As health officials continue their investigations, they have reported at least 110 cases in Minnesota and a total of 212 cases nationwide, with Chipotle identifying a specific lot of jalapeño peppers as the source of the problem. Consequently, the company removed the implicated jalapeños and substituted them with products from alternate growers, taking proactive measures once the public health threat became apparent.
Health experts underscore that such foodborne illnesses often originate at the agricultural level, emphasizing the importance of tracing contamination back to its source. Peter Pitts, a former FDA associate commissioner, highlighted that contamination can arise from various factors, including farm practices and water supply quality.
Chipotle’s recent history of food safety violations raises questions regarding their compliance and preventive measures. The lawsuit references prior incidents, including a salmonella outbreak in 2015 that sickened dozens and a 2020 case leading to a million criminal fine related to multiple illnesses. The suit suggests that the company failed to uphold its commitments to food safety and proper ingredient sourcing.
Chipotle’s Chief of Corporate Affairs and Food Safety Officer has stated that the company employs a comprehensive ingredient traceability system. She reassured that immediate corrective actions were taken upon discovering the potential outbreak and affirmed that there is currently no ongoing risk associated with its restaurants.
As investigations unfold, experts predict that the number of reported cases may continue to rise, emphasizing ongoing vigilance in food safety within the industry. The escalation of illnesses related to foodborne pathogens remains a critical public health concern as the situation develops.
