Paramount Advances Settlement Talks with California over Legal Dispute
Paramount Global and California Attorney General Rob Bonta are scheduled to engage in two consecutive days of discussions at the end of October. This meeting aims to negotiate a resolution to the state’s lawsuit contesting Paramount’s ambitious 1 billion proposal to acquire Warner Bros. Discovery, a prominent move in the media landscape.
Federal Magistrate Judge Thomas Hixson has directed both parties to report the specific dates for the settlement conference by the following Tuesday. This directive was issued following a recent hearing intended to establish a timeline for these negotiations, which will also involve representatives from the Writers Guild of America.
In accordance with Judge Hixson’s order, legal counsel for both Paramount and the state of California are required to coordinate effectively to facilitate this important meeting. The aim is to schedule a face-to-face conference that will commence at 10:00 AM. However, it is important to note that this initial gathering is intended as an introductory session, where substantive resolutions may not necessarily emerge.
The negotiations appear critical, as they might help ease tensions before a trial scheduled for the following year. Paramount and the Attorney General have exhibited a rigid stance regarding their positions, making it unclear whether a mutually acceptable settlement can be reached. Attorney General Bonta has expressed that he will only consider structural remedies, which generally require divestitures from the merged companies. In contrast, Paramount has shifted its focus toward behavioral concessions, such as a commitment to release at least 30 feature films with a prescribed 45-day theatrical window.
Progress in these settlement discussions has been sluggish, marred by accusations from Bonta against Paramount regarding a lack of good faith stemming from alleged misrepresentation of details from previous meetings. Paramount has consistently countered these claims, maintaining that it has not disclosed any confidential information while affirming its willingness to participate in productive negotiations.
As the clock ticks closer to the nascent million-per-day liability fee that will commence accruing soon, the situation grows increasingly pressing. California’s Governor Gavin Newsom, along with Los Angeles Mayor Karen Bass and Attorney General Becerra, have all indicated a preference for reaching an amicable resolution to this high-stakes corporate challenge rather than prolonging litigation.
