Investigation Launched into Nike Over Allegations of Discrimination Against White Employees

Nike Inc. is under scrutiny by the US Equal Employment Opportunity Commission (EEOC) for purported allegations of discriminating against white employees through its diversity and inclusion practices. The EEOC announced on Wednesday that it has filed a court motion compelling Nike to disclose information related to claims of what it terms “intentional race discrimination” against its white workforce.
These allegations point to a suspected pattern of discrimination regarding several employment aspects, including hiring, promotions, demotions, layoffs, and even the selection for internship and career development programs. The EEOC stated that it undertook this legal action following Nike’s failure to comply with a subpoena demanding information about the criteria used in employee redundancy selections and executive compensation determinations.
Andrea Lucas, the chair of the EEOC and a notable opponent of certain racial diversity initiatives, remarked that US anti-discrimination law is “color-blind” and protects employees of “all races.” Appointed under former President Donald Trump, Lucas added that the agency aims to ensure even-handed enforcement of Title VII, a key provision of the 1964 Civil Rights Act that prohibits employment discrimination based on race, color, religion, or sex.
Nike, headquartered in Beaverton, Oregon, has not yet provided a comment on the ongoing situation. The EEOC’s actions are viewed as another effort by the Trump administration to reverse and recalibrate policies aimed at fostering diversity, equity, and inclusion (DEI) in American workplaces.
Shortly after resuming office, Trump signed an executive order aiming to eliminate what he deemed “radical” and “wasteful” DEI initiatives implemented during the Biden administration. While Nike has historically supported social justice movements such as Black Lives Matter, the company witnessed a significant increase in non-white employees during the period from 2020 to 2021, with a rise of more than four percentage points, as highlighted by a Bloomberg analysis of data reported to the EEOC.
